Parties

(a) The Hirer is Yorkshire Prop Hire Ltd, Unit 7b Nortonthorpe Industrial Park, Wakefield Rd, Huddersfield, W.Yorskhire, HD8 9LA.

(b) The Hiree / customer is the person or business named on the official order.

Official Order

All transactions with Yorkshire Prop Hire to be covered by a formal order document quoting full details of items and hire charges as agreed for a period on a weekly basis as well as confirming the customer’s full contact details, showing registered business address and VAT No where applicable.

Loss/Damage and Insurance 

The Hiree agrees that during the hire period the items shall be kept in good repair and condition. Items returned damaged or altered will be restored by Yorkshire Prop Hire who will charge on the basis of cost restoration. Items not returned or which cannot be restored will be charged at full risk value as detailed on hire. It is the responsibility of the Hiree to insure with reputable insurers. The insurance must cover the risk values against loss or damage howsoever caused from time of collection until return and to produce a certificate of insurance on demand. The Hiree must report any discrepancies within 24 hours from collection.

Alterations 

No alterations shall be made to items without prior written consent of Yorkshire Prop Hire. Any permission granted for such alterations shall be subject to the limited conditions set out in writing and detailing any agreed alterations. Labels identifying items as the property of YPH shall not be removed. The location of items at all times shall be confirmed to Yorkshire Prop Hire on demand. No items hired shall be used for any purpose other than that for which such items are hired and shall not be lent or sub-hired to any third party. All items will be photographed prior to collection for reference for both parties.

Indemnity and Limitation of Liability

The Hiree shall indemnify Yorkshire Prop Hire against all claims, expenses and legal costs in respect of damage, injury or loss arising directly or indirectly from the use or condition of items. No warranty of fitness for purpose is given by Yorkshire Prop Hire Ltd. The Hiree is respectfully reminded of copyright legislation and for them to ensure that any necessary clearances, permissions or releases have been properly obtained before using any item. Yorkshire Prop Hire shall not be liable for any complaint or claim for infringement of any copyright or other rights.

Law

All parties agree that this contract, and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with English law, and the parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.

Collection and return of goods is by the Hiree, Yorkshire Prop Hire does not supply transport and so must be arranged by the customer. Any transport used must be suited to the items being taken. This means an enclosed vehicle with blankets and ties to protect and secure the items. We reserve the right to refuse to load if we believe the items will be damaged – we want you to receive items in the best possible condition and avoid any loss or damages. Official YPH packing boxes, blankets and ties can be hired from us for an additional fee.

Hire Charges

1st week – 10% of quoted risk value
2nd week – 20% of quoted risk value
3rd week – 25% of quoted risk value

An Additional 3% is added to 3rd week and for each additional week thereafter.
Special hire charges for long periods will be prearranged as stated on the order form.

Please note the risk value is a fair and calculated price that considers not only the replacement value of goods but also ‘finders fee’ which considers rarity and availability of items should they need to be replaced.

Goods must total a minimum of £100 per transaction. Minimum hire term one week. Full payment is required before items are released for hire (in case of extension at the time of notice), except for account customers, when payment is due after 30 days from the date of order.

Extended Hire

Extended hire is considered subject to availability and not guaranteed. Extensions can only be agreed in writing with Yorkshire Prop Hire at least 5 days prior to initial agreed return date. Late fees will apply to items that surpass return date without permissions to extend.

Late Fees

Late fees are charged at 25% of the goods risk value per day.

Cancellation of Order

A cancellation fee of 50% of hire cost will be made for confirmed orders cancelled within 24 hours before collection.
